Seeking legal advice on these matters doesn't necessarily lead to an expensive and stressful trial in the family courts. While finality in the financial relationship must be reached, often clients only need help drawing up documentation to effect the agreement they've already reached.

While Mediation can be useful, it's important to understand that mediators are not able to give legal advice. So legal advice should be sought before, during and after the mediation process.

Parties need to understand what a court would consider to be a fair resolution before attempting to negotiate. A 50/50 split of assets should never be assumed as ‘automatic'. Likewise clients shouldn't assume they can divide assets in the same way friends or family may have divided theirs. So individual advice regarding your own circumstances is vital before agreeing to anything.

Unfortunately, sometimes agreement is impossible requiring Family Court proceedings, and clients require an experienced and effective advocate.
